Short-term rental Regulation (EU) 2024/1028 (Short-term rental Regulation)

On 19 May 2024, Regulation (EU) 2024/1028 on data collection and sharing relating to short-term accommodation rental services (STR Regulation) entered into force. It provides for a digital infrastructure for the collection and exchange of data relating to touristic short-term rentals. The objective is to increase transparency in the handling of rental offers on online platforms through registration procedures in the Member States.

Each accommodation unit will receive a registration number, which must be indicated in listings on online platforms. In return, platforms are required to transmit activity data on overnights and guests to the competent authorities on a monthly basis; small platforms are obliged to report on a quarterly basis.

Implementation follows the so-called opt-in principle, meaning that application of the Regulation is not mandatory. Due to the constitutional allocation of competences granting the federal provinces responsibility for tourism matters, each province decides independently whether and from which date it will apply the STR Regulation. The Federal Ministry of Economy, Energy and Tourism will establish the Single Digital Entry Point, which will serve as the interface for data exchange between online platforms and the competent authorities.

In Austria, the federal provinces of Tyrol and Vienna will likely have the necessary legal, organisational and technical requirements ready by the first quarter of 2027. In those two federal provinces, registration obligations for hosts and data transmission obligations for online platforms will apply from a date to be still specified.

More specific information on these obligations as well as on the applicable procedures will be published on the websites of the federal provinces (the links will be shared on this website upon availability).

Online platforms can contact sdep@sdep.gv.at for matters relating to the connection to the Single Digital Entry Point.

The substantive legal requirements for hosts (commercial law, private accommodation law, spatial planning law, etc.) remain unaffected by the EU Regulation in all federal provinces and continue to apply.
