Nomination as a Responsible authorised person
 

Meaning of "Responsible authorised person"

Responsible authorised persons are the cornerstone of an effective internal export control system. They serve as the primary point of contact for export control matters and ensure the company's compliance with all export control obligations.

They are authorized to submit applications on behalf of the company and, where necessary, to stop shipments.

•    Increased transparency through real-time access to the status of applications previously submitted (including paper-based applications), independent of official office hours.

•    Secure access via ID Austria (basic functionality is sufficient; registration offices are available for the activation of your ID Austria) instead of the former mobile signature system, as well as the ability to grant access rights directly to company employees within the portal (user ID and password).

•    All process steps up to the customs clearance of goods in Austria can be carried out electronically in a simpler and more convenient online process; no additional paper documentation is required.

•    Simplified and faster creation of new applications through copy functions and template management.

•    Possibility to electronically amend already submitted applications (correction mode) and secure communication through message exchange.

•    Acceleration of internal processes and enhanced electronic search capabilities.

•    Use of electronic online forms (no additional software required).

•    Use of electronic export licenses and official classification decisions with a digital official signature.

  • Managing directors with legal authority to represent the company.
  • Authorized shareholders or other persons in a managerial position.
  • Members of the management board.
  • Appointed individuals with a sufficient area of responsibility and unrestricted authority to issue instructions.

Please note: The application form for appointment as a Responsible authorised person is currently available only in the official language German.

The following supporting documents must be submitted together with the application form to the mailbox: exportkontrolle@bmwet.gv.at

  • A current criminal record certificate (available electronically via oesterreich.gv.at or from the mayor’s office).
  • A current administrative penalties register extract (available from the district authority, municipal authority, or state police directorate).
  • A current financial penalties register extract (most easily obtained via FinanzOnline under “Further Services”, “Information”, and “Other Submissions and Inquiries” by sending a message with the subject “Financial Penalties Register Extract”), or upon application by the person concerned to the nationwide competent Office for Fraud Prevention – Financial Penalties Register (applications by email to post.abb-str-finanzstrafregister@bmf.gv.at).
  • A current extract from the commercial register or business register.
  • An internal code of conduct or compliance document.

Please also note that registration in the Foreign Trade Portal (PAWA) is only possible in conjunction with an active ID Austria account (basic functionality) and no longer with the former mobile signature system.
 

  • Responsibility for compliance with foreign trade and export control regulations.
  • Responsibility for the internal implementation of export controls within the company (establishing the necessary structures).
  • Organization and definition of responsibilities, workflows, personnel selection, and training obligations.
  • Monitoring compliance with regulations and providing the necessary resources.
  • Independent authorization of all required employees as administrators in the online portal via the “Maintain Case Handler Access” function.
  • Digital signing and electronic submission of applications and application updates to the Federal Ministry of Economy, Energy and Tourism (BMWET).
