Export of defence-related products and firearms

An export is the delivery of defence-related products or firearms from Austria to a non-EU member state (= third country). Such an export is a transaction subject to authorisation.

The export (= delivery, transfer, provision or oral transfer) of software and technology that falls under items ML21 - ML22 also requires a licence.

For the export of firearms and ammunition (ML 1–3):

If the recipient is a company:

  • An application form completed and signed by the applicant, including a technical classification of the goods in question
  • A company register extract of the applicant (not older than one year), provided the legal entity is required to register or has voluntarily done so
  • A trade register extract of the applicant (not older than one year)
  • End-Use Certificate (EUC) from the recipient or end-user
  • An International Import Certificate (IIC) from the recipient or end-user

If the recipient is a private individual:

  • An application form completed and signed by the applicant, including a technical classification of the goods in question
  • A company register extract of the applicant (not older than one year), provided the legal entity is required to register or has voluntarily done so
  • A trade register extract of the applicant (not older than one year)
  • A valid official photo ID (clear, legible copy of a valid official photo identification document) of the recipient or end-user
  • An International Import Certificate (IIC) from the recipient or end-user

If the recipient is a government institution:

  • An application form completed and signed by the applicant, including a technical classification of the goods in question
  • A company register extract of the applicant (not older than one year), provided the legal entity is required to register or has voluntarily done so
  • A trade register extract of the applicant (not older than one year)
  • An End-Use Certificate (EUC) from the recipient or end-user

For the export of other defence-related products (ML 4–22):

If the recipient is a company or a government institution:

  • An application form completed and signed by the applicant, including a technical classification of the goods in question
  • A company register extract of the applicant (not older than one year), provided the legal entity is required to register or has voluntarily done so
  • A trade register extract of the applicant (not older than one year)
  • An End-Use Certificate (EUC) from the recipient or end-user

As of 1 January 2021, the United Kingdom (England, Scotland, and Wales) is no longer part of the Customs Union and the Single Market. The United Kingdom is now classified as a third country (non-EU member state). Consequently, the regulations concerning intra-EU transfers no longer apply, and an export licence is therefore required.
