Export

Export is the delivery, transfer or provision of good (wares, software and technology) from the federal territory of the Republic of Austria to another country. In case that the goods in question are included in a so-called “goods list”, such an export may be subject to authorisation.

The Federal Ministry of Economy, Energy and Tourism  is responsible for reviewing applications for the export of firearms, defence-related products and dual-use items as well as goods in accordance with the Anti-torture Regulation.

The main sources of law are national and EU legislation as well as international agreements, and embargo resolutions of the UN, EU and OSCE.

The following main aspects must be taken into account when assessing whether an authorisation is required or not:

  • Which goods are involved (classification of the goods)?
  • To which country do you want to deliver?
  • Who is the recipient/end user?
  • What is the intended use of the goods?

The export of the following goods is subject to the jurisdiction of the Federal Ministry of Economy, Energy and Tourism :

  • defence-related products and firearms,
  • dual-use items,
  • embargoed goods,
  • goods covered by the EU-Anti-Torture Regulation.

The authorisation of processes subject to the War Material Act (Kriegsmaterialgesetz) is within the authority of the Federal Ministry of the Interior.
